Terms of Sale

These Terms of Sale ("ToS") govern the commercial relationship between BrandWitness and its customers for paid access to the Store and the Pilots.
Pricing described below is an indicative credit-based structure, not yet a confirmed final grid. See the disclaimer on the Pricing page. It will be updated here once finalized.
1. Purpose and Acceptance
These ToS define the rights and obligations of the parties for the sale of paid access to BrandWitness tools via brandwitness.com. Subscribing to a paid plan implies unconditional acceptance of these ToS.
2. Offers and Pricing
Access to the Store and the Pilots runs on a credit system: each job or automation consumes credits depending on the tool, the options selected and the volume requested. Plans (Free, Starter, Pro, Business) provide a monthly credit allowance at a fixed price; use beyond a plan's allowance requires an upgrade. 3. Billing and Payment
Prices are stated inclusive of all applicable taxes. Subscriptions are billed monthly or annually (annual billing at a discount), at the customer's choice. Payment is due on each subscription anniversary date. In the event of non-payment, BrandWitness reserves the right to suspend access to paid features.
4. Term, Cancellation and Refunds
Subscriptions have no minimum commitment period. The customer may cancel at any time from their account; cancellation takes effect at the end of the current billing period. Amounts already paid for the current period are not refunded, except where required by applicable law.
5. Price Changes
BrandWitness may adjust its prices or credit costs at any time, with at least 30 days' notice sent to the customer by email before the change applies to their next billing cycle.
6. Relationship to the Terms of Use
Use of the service purchased under these ToS remains subject to the Terms of Use, in particular regarding the user's responsibility for the legality of their use.
7. Governing Law and Jurisdiction
These ToS are governed by French law. In the event of a dispute, and after an attempt at amicable resolution, the competent courts of Paris shall have exclusive jurisdiction.
