Terms of Use

These Terms of Use ("Terms") govern access to and use of the BrandWitness platform (brandwitness.com), including the Store, the Pilots and any related tool.
1. Purpose
These Terms define the conditions under which BrandWitness makes its data collection and automation tools available, and the rules that apply to any user accessing the platform.
2. Access and Account
Access to certain features requires creating an account. The user undertakes to provide accurate information and to keep their credentials confidential. Any activity carried out from an account is presumed to be the responsibility of its holder.
3. Permitted Use and User Responsibility
BrandWitness provides tools that collect publicly available data. The user is solely responsible for the legality of the use they make of these tools, in particular for compliance with:
- the applicable law in their jurisdiction (including data protection regulations such as the GDPR);
- the terms of service of the third-party platforms targeted by a collection;
- the rights of third parties (intellectual property, privacy, personal data).
BrandWitness does not verify the purpose of each collection and cannot be considered as a party to the use made of the collected data.
4. Prohibited Uses
- Collecting or processing sensitive personal data without a legal basis
- Using the platform for harassment, spam, or unsolicited mass contact
- Circumventing the technical or legal security measures of a third-party service
- Reselling or redistributing collected data in violation of the rights of the source or of third parties
Any use that BrandWitness reasonably believes to be unlawful may lead to the suspension of the account concerned.
5. Service Availability
BrandWitness uses reasonable means to keep the platform available and to maintain the tools it offers, without guaranteeing uninterrupted or error-free access. Tools may evolve, be modified, or discontinued to reflect changes in the sites and platforms they interact with.
6. Intellectual Property
BrandWitness retains all intellectual property rights attached to the platform, its interface, and its tools. Access to the service grants the user a personal, non-exclusive, and non-transferable right of use, for the duration of their subscription.
7. Suspension and Termination
BrandWitness may suspend or terminate access to an account in the event of a breach of these Terms, in particular in the event of prohibited use as described in Article 4. Wherever possible, the user will be informed of the reason before any suspension takes effect.
8. Changes to these Terms
BrandWitness may update these Terms to reflect changes to the platform or applicable law. The applicable version is the one published on this page at the time of use.
9. Governing Law and Jurisdiction
These Terms are governed by French law. In the event of a dispute, and after an attempt at amicable resolution, the competent courts of Paris shall have exclusive jurisdiction.
